Order acceptance

The following general terms and conditions of Burchard GmbH apply exclusively to the processing of orders.

Orders can be placed in writing, by telephone, by e-mail or via our online stores. The corresponding addresses can be found under point 1 ( contractual partners ).

An order is deemed to have been accepted after the supplier has issued an order confirmation to the customer, stating the general terms and conditions and cancellation policy.

The customer is liable for incorrect deliveries due to transmission errors in telephone / verbal orders.

To avoid misunderstandings, please order in writing ( fax, post, Internet ), stating the article no.,

Cancellation of an order

If we do not receive the requested amount within 14 days of the request (bank transfer in advance for shipping items or in cash for items made available for collection), your order will be automatically canceled.

A written cancellation by the buyer is not required.

Withdrawal policy

Right of withdrawal

You (buyer) have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you (buyer) or a third party named by you, who is not the carrier, has taken possession of the goods. In the case of a contract for several goods which the consumer (buyer) has ordered as part of a single order and which are delivered separately, the withdrawal period is fourteen days from the day on which you (buyer) or a third party named by you, who is not the carrier, has taken possession of the last goods.

by means of a clear statement (e.g. a letter sent by post, fax or e-mail) of your (buyer's) decision to withdraw from this contract. The withdrawal form is available for download as a PDF document at Withdrawal form. If you (buyer) make use of this option, we (seller) will send you (buyer) a confirmation of receipt of such a revocation within 24 hours (e.g. by e-mail).

To comply with the revocation period, it is sufficient that you (buyer) send the notification of the exercise of the right of revocation before the expiry of the revocation period.

Consequences of withdrawal

If you (buyer) withdraw from this contract, we (seller) shall reimburse you (buyer) for all payments we (seller) have received from you (buyer), including delivery costs (with the exception of additional costs resulting from the fact that you (buyer) have chosen a different method of delivery), that you (buyer) have chosen a different type of delivery than the cheapest standard delivery offered by us (the seller)), immediately and at the latest within fourteen days from the day on which we (seller) received the notification of your (buyer) revocation of this contract. For this repayment, we (seller) will use the same means of payment that you (buyer) used for the original transaction, unless expressly agreed otherwise with you (buyer); in no case will you (buyer) be charged any fees for this repayment. We (seller) may refuse to refund you until we (seller) have received the goods back or until you (buyer)
have provided proof that you (buyer) have returned the goods, whichever is the earlier.

You (buyer) must return or hand over the goods immediately and in any case within fourteen days at the latest from the day on which you (buyer) inform us (seller) of the revocation of this contract to the shipping address

. The deadline is met if you (buyer) send the goods before the period of fourteen days has expired. You (buyer) shall bear the direct costs of returning the goods. You (the buyer) shall only be liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods. In addition, you (the buyer) can avoid the obligation to pay compensation by not using the goods as an owner and refraining from doing anything that could impair their value.

Prices

All prices published on the Internet at www.motorrad-burchard.de are non-binding guide prices ( sales prices ) including statutory VAT (currently 19% in Germany).

We reserve the right to reduce or increase prices without prior notice to the customer.

Dealer conditions can only be granted on presentation of appropriate evidence (business registration).

An already granted dealer status can be revoked immediately if the required conditions are no longer met.

For all items in the offer, the offer price is always the cheapest alternative.
Offers are only valid for the period shown in each case.
Discount scales do not apply to offers.

Dispatch

Dispatch within Germany:

Delivery to end consumers is made against prepayment (e.g.: bank transfer, PayPal, credit card, purchase on account).
Delivery to retailers is made via SEPA direct debit.

Dispatch abroad (worldwide):

Delivery to end consumers and retailers is made against prepayment (e.g.: bank transfer, PayPal, credit card, purchase on account).

General information

Goods are always shipped as insured DHL parcels.

All invoices are issued and billed in "EURO" ( € ).

Delivery to third countries is made without VAT (currently 19% in Germany).

Shipping costs

Shipping costs within Germany:

Delivery to end consumers is free of postage and shipping costs from 50€ order value.
Delivery to the intermediate sale / dealer is made for a flat shipping fee of € 5.90 plus the applicable VAT.

Shipping costs abroad (worldwide):

Shipping costs EURO 29.00

There is no minimum order value. No minimum quantity surcharge is charged even for very small orders.

This regulation applies equally to end consumers and retailers.

Backorders

From time to time, backorders occur due to the diversity of our product range.

These are automatically stored in our EDP system and delivered as soon as possible without being requested to do so.

Backorders are not stored on special request.

Complaints

All complaints are processed by us only with a copy of the purchase invoice and a written notice of defects.

The invoice date of the goods complained about must not be more than two years ago.

Complaints about missing parts in a package must be reported to us within 24 hours of receipt.

We do not give any guarantee on electrical parts of any kind.

Justified complaints for which we are responsible will be dealt with as quickly as possible at our expense.

We do not accept complaints or returns that are sent to us freight collect (acceptance refused).

Payment terms

The delivered goods remain the property of Motorrad Burchard GmbH until the purchase price has been paid in full.

If the buyer is in default of payment or otherwise fails to fulfill his obligations under the retention of title, the seller may demand the return of the purchased item from the buyer.

The repossession of the reserved goods by the seller does not constitute a withdrawal from the contract, unless the German Instalment Purchase Act applies.
